Revised DER-32 was Issued July 28, 2017; Effective September 8, 2017

Program Policy DER-32 has been revised and the final document is available on DEC’s website at http://www.dec.ny.gov/regulations/2393.html. This policy provides guidance on:

  • application process and the general terms and conditions for the Brownfield Cleanup Agreements (BCAs) under DEC’s Brownfield Cleanup Program (BCP); and
  • process to amend and terminate a BCA.

DER-32 has also been revised to comport with the most recent amendments to Article 27, Title 14 of the Environmental Conservation Law.

The BCP Application form (with instructions) and the standard Brownfield Cleanup Agreement are available on DEC’s website at http://www.dec.ny.gov/chemical/8450.html
